I think having a distinction makes sense as these are two different things, even if there are no legal implications.

The fact that we are slightly confused by this is a sign, we should just go with what isn't confusing to the reader.

Definitely. We use the word "Contributor" differently than what the license suggests. We have Contributors of source that don't distribute the program. Or am I misinterpreting the word "distribute" which doesn't seem to be defined.

The EPL’s definition of Contributor is:
 
"Contributor" means any person or entity that distributes the Program.
 
This clearly works, but for the sake of clarity we may want to consider an alternate construction. For example, would it help readability if the defined term was “Distributor”?
