Right. As Dirk said, this is far from rare.
In fact it's very common for public sector entities to dodge information
requests by claiming that the information cannot be provided as is and
requires some work (say, to convert between formats or to redact some
personal information). So it would be extremely easy to provide data to
some businesses for a fee, claiming it was compensation for some work
done to produce the data, and then deny the data to everyone else by
saying that they cannot be given the same data as is. That becomes even
easier if the data is provided to businesses in some proprietary data
format which makes it less useful or even unusable for others.
Of course if you're an Italian public sector entity you can just close
your ears and ignore access requests from any disfavoured entity. :-)
That probably doesn't change whatever the letter of the law.
Going back to the question of the ORC scope, I wonder how many companies
we have represented on this mailing list which make use of high-value
datasets.
