Re: [jakarta.ee-spec.committee] JCP Members

In the JCP Process, there is an Associate Membership Agreement that must be signed by all Associate Members.

 

In it, it states:

 

2.4. With respect to Your Contribution(s), You represent that:

 

a. it is an original work by You and that You can legally grant the rights set out in these terms;

b. either You have not assigned Your rights in your Contribution(s) to any other party (e.g., Your employer) or, if You have assigned such rights, You have expressly retained the right to grant licenses to such Contribution(s) to any other party; and

c. it does not, to the best of Your knowledge, violate any third party's copyrights, trademarks, patents, or other intellectual property rights.

An Associate Member is an individual who wants to participate in activities of the JCP without requiring an employer’s permission. They must sign an Associate Member Agreement, which involves only a personal IP commitment. Associate Members cannot join an Expert Group, but Spec Leads can list an Associate Member as a Contributor to a JSR.

How do you ensure that you have the rights to the IP in a Contributor's contributions and that the Contributor's employer doesn't own the IP?  Isn't this why an Employer Contribution Agreement is needed?

 

I don't know if it makes any difference legally, but a contributor would not be given commit rights to the API or Specification repos so there should be no "physical" contributions.
