Drag a shapefile into an empty edit view.
You get a new map with one layer, and the layer visibility checkbox is checked.
Close the layers view (click the 'x')
Go to Window->Show View->Layers
Now the visibility checkbox is unchecked.
Bonus points: minimize uDig and then open it again. Now it is checked.
