Thanks Daniel and Mickael,Please also ask about the legality of using the GPL2 licensed tests currently in OpenJDK to test the implementation, they won't be distributed as part of a library release, used only for testing. These will be jtreg tests, the tests could be distributed separately as a test compatiblity kit under the GPL license with classpath exception.
I think if Legal do find issues, there's a better chance Oracle will listen to an organisation like Eclipse (rather than a few individual developers) and possibly be prepared to donate the standard and tck to Eclipse.
