Good point. I took your comments back to our counsel and we would like to suggest that we revise the text to read as follows:
...anyone may prepare and distribute derivative works and portions of this document in software which implements the specification, in supporting materials accompanying such software, and in documentation of such software..."
Revised versions of the license are attached.

- You will notice that there is nothing about compatibility in this license. That is because compatibility will be dealt with in the TCK license, and in the trademark license.
- You will notice that there is nothing about trademarks in this license. That is because trademarks will be dealt with in the trademark license.
