Good point. I took your comments back to our counsel and we would like to suggest that we revise the text to read as follows:

...anyone may prepare and distribute derivative works and portions of this document in software which implements the specification, in supporting materials accompanying such software, and in documentation of such software..."

Revised versions of the license are attached.

The dropping of the underlined section makes the context of the allowed derivative works completely open ended. I suppose there is no harm in that, but the reference to implementation facilitation allows me to understand what is meant by software, while without it, I'm wondering what if any scope restrictions apply. It just doesn't roll off of the tongue so to speak, but maybe that is fine.

  • You will notice that there is nothing about patents in this license. That is because the patent licenses will be dealt with via amendments to the Eclipse Foundation Intellectual Property Policy.
  • You will notice that there is nothing about compatibility in this license. That is because compatibility will be dealt with in the TCK license, and in the trademark license.
  • You will notice that there is nothing about trademarks in this license. That is because trademarks will be dealt with in the trademark license.
