Hi!
I am planing to use the OpenUP-process developing a commercial product. As
following a process should by no means be considered as a derivate work,
usage of the document templates probably should.
If this is the case one need to make own templates, though will that then
be considered a derivate work and getting me nowhere?
This ends up in the question, how can I use OpenUP to produce a commercial
product, or can't I?

Erik,
If I understand correctly, you want to adopt OpenUP as the process in your
organization/team in a project that has the objective of developing a
commercial product, correct?
If that is the case, then you can not only follow OpenUP guidance, but also
use all available templates to document your project artifacts without
restrictions.
If you were creating a process extension to OpenUP and selling the result
commercially, then restrictions would apply. However you would still be able
to create an extension plug-in to OpenUP and sell your extension plug-in. In
this case your "packaging" would contain commercial license (your plu-in)
and open source license (for OpenUP), which I understand is acceptable.
